INTRODUCTION:

This Valentine’s Day MPTC Instagram Giveaway ("Sweepstakes") is offered and sponsored by CR Mount Pleasant, LLC (the "Sponsor"), 1218 Belk Drive, Mount Pleasant, SC 29464, the owner of Mount Pleasant Towne Centre. The Sweepstakes is governed by these Official Rules. By participating in the Sweepstakes, each entrant unconditionally agrees to be bound by and comply with these Official Rules (including all eligibility requirements) and the decisions of Sponsor, which shall be final and binding in all respects.  The Sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited by law.  This Sweepstakes is a sales promotion for CR Mount Pleasant, LLC, 1218 Belk Drive, Mount Pleasant, SC 29464.

NEITHER INSTAGRAM NOR FACEBOOK SPONSOR, ENDORSE, OR ADMINISTER THE SWEEPSTAKES:

This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram or Facebook. You understand that any information or photographs you provide in connection with this Valentine’s Day MPTC Instagram Giveaway is provided to CR Mount Pleasant, LLC, the owner of the Facebook page and Sponsor of this promotion, and not to Instagram or Facebook.  Entrants agree to release and hold harmless Facebook and Instagram from any and all liability associated with this Sweepstakes.

PROMOTION PERIOD:

The Sweepstakes begins at 12:00pm Eastern Standard Time, Wednesday, February 7, 2024, and ends on Monday, February 12, 2024 at 10:00am Eastern Standard Time (the "Promotion Period"). Sponsor is responsible for the collection, submission and processing of entries and the overall administration of the Sweepstakes. Entrants should look solely to Sponsor with any questions, comments or problems related to the Sweepstakes.  Sponsor’s computer database is the official time-keeping device for the Sweepstakes.

ELIGIBILITY:

This Sweepstakes promotion is open only to legal residents of the fifty United States (including the District of Columbia) who are eighteen (18) years of age or older as of the entry date and have an Instagram account. Void where prohibited by law. Sponsor and its respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective members, officers, directors and employees (collectively, the "Promotion Entities"), and members of their immediate families and/or persons living in the same household as such persons, are ineligible to enter the Sweepstakes or win a prize. Winning a prize is contingent upon fulfilling all requirements set forth herein.  Sponsor reserves the right to verify the eligibility of winners.

ENTRY:

Enter the Sweepstakes to win your choice of a $250.00 gift card to one (1) of the following tenants at Mount Pleasant Towne Centre: Athleta, Ballard Designs, SAVI Cucina + Wine Bar, Southern Tide by M. Dumas & Sons, Sweetgrass and Sand Dollars or Wine Cellar Wine and Gifts ⁠during the Promotion Period online by FOLLOWING Mount Pleasant Towne Centre @shopmptc, FOLLOWING @thecollarfind, LIKING the Instagram post and TAGGING/COMMENTING as instructed on the post highlighted on our Instagram page, and during the Promotion Period.  Enter on Mount Pleasant Towne Centre’s Instagram page (www.instagram.com/shopmptc) during the Promotion Period. To participate, all requested information must be provided. Automated or robotic entries submitted by individuals or organizations will be disqualified. Entry must be made by the entrant. Any attempt by an entrant to obtain more than one entry by using multiple or different addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial Sweepstakes/sweepstakes subscription notification and/or entering services, will void that entrant's entries and that entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth in these Official Rules. All entries must be posted by the end of the Promotion Period in order to participate. Sponsor's database clock will be the official time keeper for this Sweepstakes.  Sponsor may run multiple promotions simultaneously.  Entry into one promotion does not constitute entry into any other.

(a) By participating in this Sweepstakes, entrant acknowledges and agrees that he or she will clearly and conspicuously disclose that he or she is participating in this Sweepstakes in the entry and any online social sharing interaction that references the Sweepstakes or that is used to obtain entries in connection with this Sweepstakes. Sponsor reserves the right in its sole discretion to disqualify any entrant who does not adequately disclose his or her participation in this Sweepstakes while engaging in any online social sharing interaction during the Sweepstakes Period.

(b) Entries, comments and content submitted or uploaded to any social media sites or other public sites in connection with this Sweepstakes (collectively, “Content Submissions”) may not contain, depict or show any content that: (i) is sexually explicit or suggestive, offensive, lewd, profane, obscene, or contains nudity or racist innuendo; (ii) promotes any activities that may appear unsafe or dangerous, or any political agenda or message; (iii) defames, misrepresents or contains disparaging remarks about Sponsor or other companies; (iv) contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) or copyrighted materials (including photographs, sculptures, paintings, and other works of art or images published via websites, television, movies or other media) owned by others, without permission; (v) contains any personal identification, such as license plate numbers, last names (first names are permitted), e-mail addresses or street addresses for any person other than entrant, or otherwise infringes on the privacy of any person other than an entrant; (vi) communicates messages or images inconsistent with the positive image and good will of Sponsor’s brand; and/or (vii) violates any law. Any Content Submissions that contain, depict or show such content; that exceed any required file size or length limits imposed by the Sponsor or any third-party social media site; and/or that violate these Content Submission requirements and/or the terms of these Official Rules will be disqualified. The Sponsor reserves the right in its sole and unfettered discretion to screen and disqualify any Content Submission that it believes is inappropriate or not suitable for publication, that does not comply with these Official Rules, or that is not consistent with the spirit or theme of the Sweepstakes.

WINNERS SELECTION:

One (1) winner will be selected in a random drawing at 10:00 AM Eastern Standard Time on Monday, February 12, 2024 from among all complete, qualified and eligible Entries received during the Promotion Period. The random drawing will be conducted by Sponsor or its designated representatives, whose decisions are final. The winner will be announced on the Instagram page of CR Mount Pleasant, LLC, owner of Mount Pleasant Towne Centre, by 10:15 AM Eastern Standard Time on Monday, February 12, 2024. Winner receives choice of a $250.00 gift card to one (1) of the following tenants at Mount Pleasant Towne Centre: Athleta, Ballard Designs, SAVI Cucina + Wine Bar, Southern Tide by M. Dumas & Sons, Sweetgrass and Sand Dollars or Wine Cellar Wine and Gifts. In the event of non-compliance with applicable requirements of these Official Rules, the prize will be forfeited and an alternate winner will be selected.  Entrants waive the right to assert, as a cost of winning the prize, any and all costs of redemption or travel to redeem the prize.  Winners shall pick up their prize at the Mount Pleasant Towne Centre management office at 1218 Belk Drive, Mount Pleasant, SC 29464. If prize is not picked up with ten (10) days of notification, the prize will be forfeited and an alternative winner will be selected.  Ineligible entrants will be disqualified and the prize awarded to alternates.  The odds of winning depend on the number of valid entries received.

PRIZES:

One (1) winner of this promotion will receive choice of a $250.00 gift card to one (1) of the following tenants at Mount Pleasant Towne Centre: Athleta, Ballard Designs, SAVI Cucina + Wine Bar, Southern Tide by M. Dumas & Sons, Sweetgrass and Sand Dollars or Wine Cellar and Gifts. These prizes are the only prizes that will be awarded. The odds of winning this Valentine’s Day MPTC Instagram Giveaway depends on the number of eligible entrants that participate in the promotion.  A total of one (1) prize will be awarded in the promotion. [Gift cards are subject to the terms and conditions of the issuer.] Prize cannot be transferred, redeemed for cash or substituted by winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The awarding of the gift card prize does not obligate the winner.  No costs, fees or other monetary obligation must be satisfied before the entrant/winner is entitled to receive or use the gift card prize.  The approximate verifiable retail price or value of the prize represents Sponsor's good faith determination, which is final and binding and cannot be appealed.  If the actual value of the prize turns out to be less than the stated approximate retail value or price, the difference will not be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items. All federal, state or local taxes, fees, or surcharges associated with the receipt or use of any prize are the sole responsibility of the prize winner. Failure to comply with the Official Rules will result in forfeiture of the prize.

PRIVACY:

Any personal information that you provide in connection with the Sweepstakes shall be used by Sponsor to administer this Sweepstakes, contact entrants, and for the other purposes set forth in  the Sponsor’s privacy policy located at https://www.mtpleasanttownecentre.com. By entering this Sweepstakes, you agree to and accept that privacy policy. If entrant authorizes, by opting in, Sponsor may provide entrant with information relating to products, services and promotions of Sponsor and affiliates of Sponsor.

RELEASE:

By participating in the Contest, each entrant completely and fully releases and agrees to indemnify and hold harmless Sponsor, Instagram, Facebook, Inc., the Facebook Platform, and their respective affiliates, members, shareholders, officers, directors, agents, employees, attorneys, successors and assigns (collectively, the "Released Parties") from any and all liability, claim, demand, action, or cause of action of every kind, direct, indirect and consequential, legal, equitable and otherwise, known and unknown, conditional and unconditional (collectively, "Claims") against any one, or more, or all, of the Released Parties arising out of, in connection with or relating to this Sweepstakes or the entrant's participation in this Sweepstakes, or resulting from the entrant's possession, use or misuse of any prize.

BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES RELATED ACTIVITY, INCLUDING ACCESS TO AND USE OF THE INTERNET SITES IDENTIFIED ABOVE OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error. Sponsor assumes no responsibility for any misdirected or lost mail, or any error, omission, interruption, deletion, defect, delay of operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to entrant's or any other person's computer related to or resulting from participating downloading materials in the Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes.

DISPUTES:

In the event of a dispute concerning which eligible entrant won the Sweepstakes, the decision of Sponsor's representative will be final. The potential winner may be requested by Sponsor's representative to provide Sponsor with proof that the potential winner is twenty-one (21) years of age or older as of the entry date and the holder of the applicable Facebook and/or Instagram account. If an entrant is eighteen (18) years of age or older but deemed a minor in his or her state of residence, such entrant must have the consent his or her parent or legal guardian to participate in this Valentine’s Day MPTC Instagram Giveaway.  In such case, proof of consent may be required at any time by Sponsor's representative before the prize is awarded.  If a dispute cannot be resolved to Sponsor's satisfaction, the entrant will be deemed ineligible. Except where prohibited by law, you agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with the Sweepstakes or any prize awarded shall be resolved individually and exclusively by the appropriate court in South Carolina; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred with entering the Sweepstakes, but in no event attorney’s fees.

A copy of these Official Rules is available at www.mtpleasanttownecentre.com/events and the Management Office of Mount Pleasant Towne Centre, 1218 Belk Drive, Mount Pleasant, SC 29464.  The names of the winners will be available upon request at no charge at the management office of Mount Pleasant Towne Centre, 1218 Belk Drive, Mount Pleasant, SC 29464 within 10 days after the end of the Sweepstakes or by mail at no charge within such period by writing to CR Mount Pleasant, LLC, 1218 Belk Drive, Mount Pleasant, SC 29464, Attention:  Mount Pleasant Towne Centre Valentine’s Day MPTC Instagram Giveaway promotion.
